Terms of Service

1. Purpose

These Terms of Service (hereafter "Terms") govern the use of the Batlr mobile application, published by Lucas Khoury, available on iPad and iPhone via Apple's App Store, as well as the batlr.app website and the associated reservation widget.

By downloading or using the application, browsing batlr.app, or making a reservation through a Batlr widget, you accept these Terms in full.

2. Service Description

Batlr is a management application for restaurants. It includes:

There are no separate paid modules (email, SMS, payments, online reservations): everything is included in Pack Pro.

2.3 Pack Pro Subscription Model

Pack Pro is offered in five tiers, based on the number of restaurants managed from a single account:

The prices above are indicative; actual prices are those displayed in Apple's App Store at the time of subscription, in your Apple account's local currency, including any applicable taxes.

The five tiers belong to a single subscription group on the App Store; you can hold only one active tier at a time, and tier changes take effect without interruption from the App Store.

3. Registration and Account

To use Batlr, you must create an account by providing accurate and up-to-date information. You are responsible for the confidentiality of your login credentials.

Authentication is available by email and password, by Sign in with Apple, or by Sign in with Google. Servers and other team members can sign in via a PIN code without an email address, under the responsibility of the account manager.

The application is intended for restaurant professionals. By creating an account, you declare that you are acting in a professional capacity.

4. Subscriptions and Payment

4.1 Subscription

Pack Pro is sold exclusively via Apple's App Store (StoreKit in-app purchase). Apple acts as the reseller of the service per App Store documentation.

4.2 Renewal

Subscriptions renew automatically at the end of each period, unless cancelled by the user at least 24 hours before the end of the current period, in accordance with standard App Store terms.

4.3 Management and Cancellation

Subscriptions are managed in your Apple account settings (App Store → your profile → Subscriptions). Cancellation takes effect at the end of the current period. No pro-rata refund is issued for the current period.

Refund requests must be sent directly to Apple via reportaproblem.apple.com, in accordance with App Store policy.

4.4 Pricing

Prices are displayed in the App Store, expressed in your Apple account's local currency, including any applicable taxes. Batlr reserves the right to change its prices. Any change will be communicated at least 30 days before taking effect. Current subscriptions are not affected until their next renewal.

4.5 Free Trial

A 30-day free trial is offered on the Pack Pro 1 tier, triggered on your first interaction with a Pro feature inside the application. At the end of the trial period, the subscription is billed automatically by Apple, unless cancelled beforehand from your Apple account.

The free trial is available only once per Apple ID, in line with the App Store's introductory offer policy.

4.6 Reservation-related Payments

When a restaurant enables the Payments feature, card holds, prepayments, and no-show charges are processed via Stripe Connect. The restaurant subscribes to a connected Stripe account in its own name; Batlr acts as a technical platform and does not collect reservation-related funds. The restaurant is solely responsible for its contractual relationship with Stripe and for the compliance of its cancellation policy with applicable legal requirements.

6.1 Restaurant Customer Data

As a restaurant operator, you are the data controller under applicable privacy law (GDPR for EU operators, analogous frameworks elsewhere) for the customer data you enter into Batlr or that you collect through the public widget and restaurant page. You agree to inform your customers about the collection of their data, to obtain their consent where required by law, and to comply with applicable regulations.

Batlr acts as a data processor in accordance with GDPR Article 28 (or its analog in your jurisdiction). The processing terms are described in the Privacy Policy.

6.2 Backup

Batlr performs regular backups of your data. Nevertheless, we recommend that you keep your own copies of essential data through the export functions available in the application.

6.3 Offline Continuity

Some operations (creating reservations, customer updates, floor plan) are stored locally on the device and synchronized once connectivity is restored. Critical operations (payments, team management, restaurant settings) require an active connection.

7. Intellectual Property

The Batlr application, its design, source code, content, and brand are the exclusive property of the publisher. Any reproduction, even partial, is prohibited without prior written authorization.

You retain full ownership of the data you enter into Batlr; you grant Batlr a non-exclusive license limited to the operation, hosting, and backup of that data for the sole purpose of providing the service.

8. Service Availability

Batlr strives to ensure the availability of the application 24/7. However, access may be temporarily interrupted for maintenance, updates, or in cases of force majeure, without giving rise to compensation.

No quantified service-level agreement (SLA) is provided at this time; this clause may evolve in a future version of these Terms.

Batlr is provided "as is." To the extent permitted by law:

You may stop using the application and delete your account at any time:

Cancellation of a Pack Pro subscription must be performed separately from your Apple account; deleting your Batlr account does not automatically cancel the subscription contracted with the App Store.

Batlr reserves the right to suspend or terminate your account in case of a violation of these Terms, after prior notice except in justified urgent cases.

11. Changes to the Terms

Batlr may change these Terms at any time. Changes will be communicated through the application or by email at least 30 days before taking effect. Continued use of the application after that date constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by French law (as Batlr is operated from France). In case of a dispute, the parties agree to seek an amicable solution. Failing that, and subject to mandatory consumer-protection rules, the courts of Paris shall have sole jurisdiction.
