Terms of Service

1. Purpose

These Terms of Service (hereafter "Terms") govern the use of the Batlr mobile application, published by Lucas Khoury, available on iPad and iPhone via Apple's App Store.

By downloading or using the application, you accept these Terms in full.

2. Service Description

Batlr is a management application for restaurants. It includes:

2.1 Free Features (no limitation)

• Reservation management
• Interactive floor plan
• Customer database and CRM
• Dashboard and analytics
• Waitlist
• Team management and PIN-based access

2.2 Paid Modules (optional subscription)

• Email notifications (included in Pack Pro): unlimited emails, confirmations, reminders, post-visit follow-ups, customizable templates, sending from your own domain (SPF/DKIM)
• Online reservations (€29.99/month): reservation widget, automatic confirmations, marketing campaigns, customer segmentation
• Payments (€19.99/month): card hold, prepayment, no-show billing, cancellation policy
• SMS (€19.99/month): 150 SMS included/month, last-minute short reminders, waitlist notifications, top-ups available
• Pack Pro (€59.99/month): all modules combined with unlimited emails and 150 SMS included/month

3. Registration and Account

To use Batlr, you must create an account by providing accurate and up-to-date information. You are responsible for the confidentiality of your login credentials.

The application is intended for restaurant professionals. By creating an account, you declare that you are acting in a professional capacity.

4. Subscriptions and Payment

4.1 Subscription

Paid modules are available through a monthly or annual subscription, purchased via Apple's App Store (in-app purchase).

4.2 Renewal

Subscriptions renew automatically at the end of each period, unless cancelled by the user at least 24 hours before the end of the current period.

4.3 Management and Cancellation

Subscriptions are managed in your Apple account settings (App Store → your profile → Subscriptions). Cancellation takes effect at the end of the current period. No pro-rata refund is issued for the current period.

4.4 Pricing

Prices are shown in euros, tax included. Batlr reserves the right to change its prices. Any change will be communicated at least 30 days before taking effect. Current subscriptions are not affected until their next renewal.

4.5 Free Trial

If a free trial is offered, it is indicated in the application. The subscription will be billed at the end of the trial period, unless cancelled beforehand.

5. Use of the Application

You agree to:

• Use the application in accordance with its intended purpose and applicable laws
• Not attempt to decompile, modify, or circumvent the application's security measures
• Not use the application for illegal or fraudulent purposes
• Respect Batlr's intellectual property rights

6. Data and Responsibility

6.1 Restaurant Customer Data

As a restaurant operator, you are the data controller under applicable privacy law (GDPR for EU operators, analogous frameworks elsewhere) for the customer data you enter into Batlr. You agree to inform your customers about the collection of their data and to comply with applicable regulations.

Batlr acts as a data processor for this data, in accordance with GDPR Article 28 (or its analog in your jurisdiction).

6.2 Backup

Batlr performs regular backups of your data. Nevertheless, we recommend that you keep your own copies of essential data.

7. Intellectual Property

The Batlr application, its design, source code, content, and brand are the exclusive property of Batlr. Any reproduction, even partial, is prohibited without prior authorization.

8. Service Availability

Batlr strives to ensure the availability of the application 24/7. However, access may be temporarily interrupted for maintenance, updates, or in cases of force majeure, without giving rise to compensation.

9. Limitation of Liability

Batlr is provided "as is." To the extent permitted by law:

• Batlr does not guarantee that the application will be free of errors or interruptions
• Batlr's liability is limited to the amount of subscriptions paid in the last 12 months
• Batlr is not responsible for indirect damages, data loss, or lost profits

10. Termination

You may stop using the application and delete your account at any time from the application settings or by contacting contact@batlr.app.

Batlr reserves the right to suspend or terminate your account in case of a violation of these Terms, after prior notice except in urgent cases.

11. Changes to the Terms

Batlr may change these Terms at any time. Changes will be communicated through the application or by email at least 30 days before taking effect. Continued use of the application after that date constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by French law (as Batlr is operated from France). In case of a dispute, the parties agree to seek an amicable solution. Failing that, the courts of Paris shall have sole jurisdiction.
